About these terms
These terms are an agreement between you and DNMCast, operated by [Company legal name]. They apply when you use our website (https://www.dnmcast.com), our customer panel (https://app.dnmcast.com), the DNMCast Player app or our web player.
By creating an account or using DNMCast, you agree to these terms. If you are signing up for a business, you confirm that you are allowed to accept these terms on its behalf, and "you" means that business.
Our Privacy Policy and Refund Policy also form part of these terms.
The service
DNMCast is a cloud digital-signage service. You upload images and videos, arrange them into playlists and campaigns, and play them on screens running our player apps. The panel also shows screen status and play reports.
We may improve, change or remove features over time. If we remove something important to a paid plan, we will tell you in advance.
Your account
- You can sign up with an email and password or with Google sign-in.
- You must be at least 18 and give us accurate details, and keep them up to date.
- Keep your login private. You are responsible for everything done through your account, including by anyone you share access with.
- Tell us straight away at [support email] if you think someone has used your account without permission.
Free trial
New accounts get a free trial for 14 days with 1 screen. No card is needed to start. At the end of the trial, you need to choose a paid plan to keep your screens playing. If you do not, your screen will show a "subscription expired" notice.
We may limit free trials to one per business, and may end a trial early if it is being misused.
Plans and billing
Per-screen pricing
Paid plans are charged per screen, per month. Current plans and prices are shown on our pricing page and in the panel. Each plan has limits, such as the number of screens and the amount of storage. Enterprise plans for larger networks are priced by custom quote.
You can pay monthly or yearly. Yearly billing costs the same as 10 months, so you get 2 months free.
Renewals
Your subscription renews automatically at the end of each billing period (monthly or yearly) until you cancel. You authorise us and our payment partners to charge you for each renewal.
Adding and removing screens
- Adding screens during a billing period: you pay a pro-rata amount for the days left in that period.
- Removing screens: the change takes effect at your next renewal. We do not give pro-rata refunds for screens removed mid-period.
Payments
Payments are processed by our payment partners (such as Razorpay, Stripe or Paddle). Customers in India usually pay in Indian rupees (INR); international customers pay by card in the currency shown at checkout. For some international customers, a payment partner may act as the reseller or merchant of record, and its own terms will also apply to that purchase.
Taxes and GST
Prices do not include taxes unless we say so. For customers in India, 18% GST is added to the price and shown on a GST invoice. Please give us your GSTIN if you want to claim input tax credit. International customers are responsible for any taxes that apply in their country, unless our payment partner collects them at checkout.
Failed payments
If a payment fails, we will let you know and give you a grace period of 7 days to pay. Your screens keep playing during this time. If payment is still not made after 7 days, your screens will show a "subscription expired" notice until your account is paid up.
Price changes
We may change our prices. We will give you at least 30 days' notice by email or in the panel. The new price applies from your next renewal after the notice period. If you do not agree, you can cancel before then.
Cancellation
You can cancel anytime from your panel. Cancelling stops your subscription from renewing. Your plan stays active until the end of the period you have already paid for, and then ends. Refunds are covered by our Refund Policy.
Acceptable use and content rules
You are responsible for everything you upload and display through DNMCast. You must not use DNMCast to display or share content that:
- you do not own or have the rights or licences to use;
- infringes anyone's copyright, trademark, privacy or other rights;
- is illegal, or breaks any law or advertising rules that apply where your screens are;
- is hateful, abusive, threatening or promotes violence or discrimination;
- is sexually explicit or adult content;
- is false, misleading or deceptive.
You also must not:
- upload malware, viruses or any harmful code;
- try to hack, overload or disrupt DNMCast, or access other customers' accounts or data;
- copy, resell or reverse-engineer the service or our apps, except where the law allows;
- use the service to send spam.
We do not check all content before it plays, but we may remove content or suspend accounts that break these rules.
Your content
You own the media and other content you upload. We do not claim ownership of it.
You give us a limited, worldwide, non-exclusive licence to store, copy, process, resize or convert, and deliver your content to your screens, only so that we can provide the service to you. This licence ends when your content is deleted from our systems, except for copies in backups that are deleted on their normal schedule.
You promise that you have all the rights needed to display your content, including any music, images, logos or people that appear in it.
The TV app and your devices
To play content you need a compatible screen or device (such as an Android TV or Android box running the DNMCast Player app, or a device with a web browser for our web player) and a working internet connection. You provide and pay for your devices, internet and electricity.
Our apps save your media on the device so it can keep playing during short internet outages. You are responsible for the physical security of your devices and for who can access them.
We give you a personal, non-transferable right to install and use our apps only with DNMCast while your account is active.
Availability
We make reasonable efforts to keep DNMCast running smoothly, but we do not guarantee that it will always be available, uninterrupted or error-free. We may need to carry out maintenance, and problems with the internet, your devices or third-party providers can affect the service.
The service is provided "as is" and "as available". To the extent the law allows, we do not give any other promises or warranties about the service.
Suspension and termination
We may suspend or close your account, or remove content, if:
- you break these terms or our content rules;
- your payments are overdue after the grace period;
- we are required to by law or by a lawful order; or
- your use puts the service, other customers or the public at risk.
Where reasonable, we will warn you first and give you a chance to fix the problem. For serious breaches we may act straight away.
You can stop using DNMCast at any time by cancelling your subscription.
Your data after termination
After your subscription ends or your account is closed, we keep your account data and content for about 90 days, so you can return and pick up where you left off. After that we may permanently delete it. If you want a copy of your content, please download it before your account ends.
We keep billing records and invoices for as long as the law requires. See our Privacy Policy for more.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as lost profits, lost sales, lost data or damage to reputation, even if we were told they could happen;
- our total liability to you for any claim related to DNMCast is limited to the fees you paid us in the 12 months before the event that led to the claim.
Nothing in these terms limits liability that cannot be limited by law.
Indemnity
If someone makes a claim against us because of content you displayed, or because you broke these terms or the law, you agree to cover our reasonable losses and costs, including legal fees, arising from that claim.
Changes to these terms
We may update these terms from time to time. We will change the "Last updated" date at the top, and for important changes we will tell you by email or in the panel at least 30 days before they apply to you. If you keep using DNMCast after that, you accept the new terms. If you do not agree, you can cancel.
Governing law
These terms are governed by the laws of India. Any dispute will be handled by the courts at [City for courts, e.g. Bareilly], India. Before going to court, please contact us so we can try to sort things out together.
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still enforce it later.
